*CAN THE REGISTRATION OF THE ADC PARTY BE REVOKED UNDER NIGERIAN LAW RIGHT NOW? THE ANSWERED IS NO. HOWEVER….*
Those who filed the case to revoke the registration of the ADC party based their argument on Section 225A of the 1999 Constitution, which requires the electoral commission to revoke the registration of any party that fails to secure 25% of votes cast in the previous election.
The 1999 Constitution indeed requires INEC to revoke the registration of any party that fails to obtain 25% in at least one state in Nigeria in a presidential election. Did ADC obtain 25% in any one of Nigeria's states in the 2023 election?
The answer is no, it did not!!!
So what then?
The 1999 Constitution provides **two conditions** that must be met before a political party's registration can be revoked:
1. The 25% rule
2. The Zero seat rule
Beyond failing to obtain 25%, the party must also have failed to win even a single seat — meaning it won no seat whatsoever in a State House of Assembly, House of Representatives, or the Senate.
If a party wins even just one State House of Assembly member, INEC has no power to revoke its registration in the next election, even if the elected member later leaves the party.
**ADC won 2 seats in the House of Representatives in the 2023 election, and also won 3 State House of Assembly seats in some states — and even one seat would have been sufficient.**
Perhaps those who filed the case forgot about Hon. Idris Salman, who won the House of Representatives election in Kogi State in 2023, and also Hon. Abejide Joseph Leke — both under ADC in Kogi State in 2023.
If a party fails to obtain 25% **and** fails to win even a single seat, then INEC is obligated to revoke its registration. Likewise, if a party obtains 25% of votes in any state in a presidential election, INEC has no authority to revoke its registration even if it holds no seat in any State, Federal, or Senate assembly.
