LEGAL POSITION PAPER
OPPOSING THE AMENDMENT OF SENATE RULES TO ALLOW REMOTE, VIRTUAL, OR IN ABSENTIA VOTING IN SENATE FLOOR PROCEEDINGS, PARTICULARLY IN CONNECTION WITH THE PENDING IMPEACHMENT HEARING OR OTHER CONSTITUTIONALLY MANDATED DELIBERATIVE FUNCTIONS

I. INTRODUCTION

This Position Paper respectfully submits that any attempt to amend Senate Rules to permit remote, virtual, internet-based, proxy, or in absentia voting in Senate floor proceedings—particularly where such amendments may affect constitutional functions such as impeachment proceedings—raises serious constitutional, procedural, due process, institutional integrity, and public accountability concerns.

While the Senate possesses constitutional authority to determine its own rules of proceedings, such authority is not absolute and cannot be exercised in a manner that defeats constitutional safeguards, diminishes deliberative integrity, or alters the constitutional character of Senate proceedings.

II. ISSUES PRESENTED
Whether amendments permitting:

Remote or virtual voting by Senators not physically present in session;

In absentia participation and voting in Senate floor proceedings;

Altered definitions of “presence” for quorum and voting purposes;

are constitutionally not permissible, particularly where such changes may affect impeachment proceedings or other constitutional functions.

III. CONSTITUTIONAL FRAMEWORK

A. Senate Rule-Making Power Is Subject to Constitutional Limitations
The 1987 Constitution provides:

Article VI, Section 16(3):
“Each House may determine the rules of its proceedings…”

However, jurisprudence recognizes that parliamentary autonomy cannot override constitutional mandates.

Internal rules remain subject to constitutional limitations where their implementation results in:

Grave abuse of discretion;

Violation of due process;

Defeat of constitutional design;

Erosion of institutional accountability.

Thus:
The Senate’s power to make rules does not include power to adopt rules inconsistent with constitutional functions.

B. The Constitution Requires Deliberative Legislative Participation

The Constitution provides:
Article VI, Section 16(2):

“A majority of each House shall constitute a quorum…”

The constitutional concept of quorum presupposes actual participation in legislative deliberation.

Historically and institutionally, Senate sessions contemplate:

Physical convening;

Immediate participation;

Real-time deliberation;

Accountability before peers and the public.

Redefining “presence” to include absence from the chamber fundamentally alters constitutional expectations attached to quorum and deliberation.

IV. IMPEACHMENT IS A CONSTITUTIONAL FUNCTION REQUIRING HEIGHTENED STANDARDS
The Constitution provides:
Article XI, Section 3(6):

“The Senate shall have the sole power to try and decide all cases of impeachment.”

The phrase:
“try and decide” imports judicial and adjudicativej responsibilities.

Senators act not merely as legislators but as Senator-Judges bound by constitutional oath.
Impeachment proceedings require:

-Direct participation;
-Observation of evidence;
-Deliberative interaction;
-Public accountability;
-Independent judgment.

Remote or in absentia participation may impair:
-Deliberative quality;
-Integrity of proceedings;
-Transparency;
-Public confidence.

V. DUE PROCESS PRINCIPLES PROHIBIT ALTERING PROCEDURAL RULES TO AFFECT PENDING CONSTITUTIONAL PROCEEDINGS

Fundamental due process requires:
Stability of governing procedures
Changing voting procedures during or immediately preceding constitutional proceedings risks:

1. Appearance of procedural manipulation;

2. Unequal application;

3. Predetermined outcomes;

4. Institutional bias.

The Supreme Court has consistently recognized that impeachment remains subject to constitutional due process requirements, notwithstanding its political character.

Thus:
Procedural amendments perceived as facilitating or obstructing constitutional accountability mechanisms may violate due process norms.

*VI. RULE CHANGES CANNOT DEFEAT THE CONSTITUTIONAL PURPOSE OF IMPEACHMENT*

Impeachment exists as:
The Constitution’s mechanism for public accountability of high officials.
Any procedural amendment has the practical effect of:

Delaying accountability;
Avoiding participation;
Altering voting standards;
Weakening institutional responsibility;
must be strictly scrutinized.

The constitutional purpose of impeachment cannot be undermined indirectly through procedural engineering.

VII. PUBLIC ACCOUNTABILITY AND TRANSPARENCY REQUIRE PERSONAL VOTING

Senate votes—particularly impeachment votes—carry constitutional consequences.
Physical participation ensures:

Public visibility;

Immediate accountability;

Transparency;

Integrity of deliberation;

Protection against coercion or undue influence.

Remote voting creates unresolved concerns regarding:
-Verification;
-Independence;
-External influence;
-Security;
-Confidentiality;
-Authenticity.

VIII. DOCTRINE AGAINST ARBITRARY OR SELF-SERVING PROCEDURAL MODIFICATION

Legislative bodies possess discretion over procedure, but constitutional governance rejects:

Procedural changes primarily designed to affect outcomes in specific controversies.
Where amendments appear timed to influence pending constitutional matters, questions arise regarding:
-Good faith;
-Equal application;
-Abuse of procedural authority.

IX. RELIEF SOUGHT / POSITION
For the foregoing reasons, it is respectfully submitted that:
The Senate should:

1. Reject amendments permitting remote, virtual, internet-based, or in absentia voting in constitutional proceedings;

2. Preserve traditional requirements of direct participation and accountability;

3. Maintain physical presence requirements for quorum and voting in proceedings involving constitutional accountability;

4. Defer any procedural reforms until after completion of pending constitutional proceedings to avoid appearance of procedural manipulation.

X. CONCLUSION
The constitutional authority of the Senate to determine its own rules does not extend to altering the essential character of Senate participation in ways that weaken accountability, diminish deliberative integrity, or undermine constitutional processes.

Where constitutional functions such as impeachment are implicated, procedural amendments allowing remote or absent voting must be subjected to the highest level of constitutional scrutiny.

The legitimacy of constitutional governance depends not only upon outcomes, but upon public confidence that such outcomes are reached through fair, transparent, and constitutionally faithful procedures.
