HIGH PRIORITY (Medical Staff Competency Watch)

AGING PHYSICIANS & PATIENT SAFETY: SHOULD HOSPITALS ASSESS COMPETENCY BASED ON AGE OR PERFORMANCE?
(This is especially relevant to MSPs responsible for OPPE, FPPE, peer review, medical staff policies, and credentialing.)

What changed?
A new Washington Post investigation examines concerns surrounding America's aging physician workforce and how hospitals identify declining clinical performance.

The report highlights:
- Approximately 47% of active U.S. physicians are age 55 or older.
- Concerns about physical and cognitive changes that may affect some physicians' clinical performance.
- Hospitals implementing age-based screening policies, which have raised discrimination and fairness concerns.
- Arguments for ongoing, performance-based competency assessment rather than relying on chronological age alone.

The article discusses litigation involving an orthopedic surgeon whose alleged clinical impairment resulted in hundreds of lawsuits. These allegations should not be interpreted as evidence that older physicians generally provide unsafe care.

Why MSPs should care
This is directly connected to medical staff oversight responsibilities.
MSPs and physician leaders should consider whether their organizations have clear processes for evaluating clinical competence, addressing potential impairment, and responding to performance concerns. Relevant areas include OPPE and FPPE, peer review, practitioner health policies, fair hearing protections, and consistent application of medical staff bylaws.

Important distinction: This news report does not announce a new CMS or Joint Commission requirement for age-based physician screening.

MSP Huddle discussion question:
Should hospitals evaluate physician competency through age-based screening, ongoing performance monitoring, or a combination of both?
