Postpartum Support International Calls for Reform as Lindsay Clancy Case Ends in Mistrial

The jury in the trial of Lindsay Clancy was unable to reach a unanimous verdict. PSI is disappointed, but not surprised.

This case forces a difficult reckoning: the U.S. continues to prosecute mothers for the consequences of a severe, poorly understood, temporary, and treatable mental health condition related to childbirth: a truth our medical and legal systems have failed to recognize.

More than two dozen countries, including England, Canada, and Australia, have infanticide laws allowing a mother’s mental state in the first 12 months postpartum to inform criminal responsibility, directing her toward psychiatric care rather than prison (Spinelli, American Journal of Psychiatry, 2004; Feingold and Lewis, Archives of Women’s Mental Health, 2025). Untreated postpartum psychosis carries a documented infanticide risk of roughly 1 to 4 percent (Alford et al., Archives of Women’s Mental Health, 2025). The U.S. has no comparable legal framework.

PSI will keep pushing for education, for access to emergency perinatal psychiatric care, and for laws in every state that treat these mothers as patients.

During a lactation consultation; we examine your baby’s tone, development, reflexes & oral function. We observe your baby feeding, their suck, swallow, breathe, and how they interact. We observe their nervous system states. You can’t feed a baby at the breast or with a bottle and not evaluate the baby. UnitedHealthCare is removing coverage for babies. Please call them & say you won’t stand for it.

1 to 2 in every 1,000 mothers will experience postpartum psychosis, yet most people have never been taught the signs.

Misdiagnosing this condition is dangerous. While postpartum depression causes severe sadness, hopelessness, and exhaustion, postpartum psychosis is a psychiatric emergency. It involves a sudden break from reality, including hallucinations, delusions, and severe confusion.

One is an illness that requires ongoing therapy and medication; the other is an acute medical crisis that requires immediate, emergency hospital intervention. Misidentifying the signs delays life-saving care.

Knowing the difference isn’t just helpful, but can save a mother’s life.

Postpartum Psychosis is a severe mental illness. It is not a moral failure, a character flaw, or something anyone chooses. It is an illness, and with the right care, full recovery is possible.

*️⃣ Perinatal and Postpartum Psychosis as a medical and psychiatric emergency. If you think someone you love is experience postpartum psychosis, call or text the National Maternal Mental Health Hotline at 833-852-6262 (free, confidential, and available 24/7), call 911, or proceed to the nearest emergency room. *️⃣

It affects 1-2 out of every 1,000 births, about as common as conditions like severe pre-eclampsia or multiple sclerosis. Symptoms can include confusion, hallucinations, delusions, extreme agitation, or an inability to sleep.

Important update for SNOO Smart Sleeper users:

If you have, or are considering purchasing a SNOO Smart Sleeper, please be aware that its manufacturer, Happiest Baby, Inc., has been selling new sleep sack sizes and hospital SNOO bassinet bundles without first undergoing FDA review and obtaining FDA authorization.

The FDA strongly cautions patients, caregivers and health care providers that the X-Small and X-Large sleep sacks, and the SNOO Hospital Bundle, have not been evaluated for safety and effectiveness by the FDA and pose increased risks as described in the Warning Letter. The FDA also cautions that stains, soiling and unsanitary conditions have been reported on refurbished SNOOs distributed to customers, which may pose risk of infection. The FDA also cautions that mold has been reported on SNOO Smart Sleeper mattresses and/or mattress covers. Users should report any problems with SNOO products through the MedWatch Voluntary Reporting Form.
