'On July 24, 2026, Italy’s Corte di Cassazione (Supreme Court) handed down a ruling that strengthens consumer rights around cell phones and a wide range of other technology. The case, Briganti v. Apple, was brought by an Italian woman who purchased an iPhone in 2016 and asserted that Apple had failed to give her adequate information or to recommend precautions about possible risks of extensive iPhone use and related exposure to radiofrequency emissions. Italian lawyer Fabio Cardanobile successfully argued that consumer information is itself a legally protected right — meaning that even if scientific evidence concerning health effects is not yet conclusive, consumers should receive relevant information that allows them to make informed choices about how they use a product.'

BREAKING: Court Gives FCC 30 Days to Respond to CHD Petition on Wireless Harms

The Defender reports:

The FCC has 30 days to explain why it hasn’t complied with a 2021 court order requiring the agency to reveal how it determined that current radiofrequency radiation exposure limits adequately protect people and the environment.

“This is an important step in fixing an issue that has been going on for far too long. We need to address the growing public health threat of wireless radiation, with urgency," said Miriam Eckenfels, director of CHD’s Electromagnetic Radiation (EMR) & Wireless Program.

One in 8 U.S. adults reported adverse health effects from exposure to wireless radiation, according to a March peer-reviewed report of nationally representative survey results.

In February, Paul Héroux, Ph.D., authored a report showing how EMR exposure from wireless radiation and electrical power grids is linked to the global diabetes epidemic. The report traces evidence of how EMR can dysregulate and raise blood sugar levels.

Wireless radiation from cellphones can cause abnormal blood clumping, even when the phone is held an inch away from the skin, according to an April 2025 peer-reviewed study.

The study’s author, Dr. Robert Brown, recently wrote 𝘜𝘯𝘗𝘭𝘶𝘨: 𝘈 𝘙𝘢𝘥𝘪𝘰𝘭𝘰𝘨𝘪𝘴𝘵 𝘌𝘹𝘱𝘭𝘰𝘳𝘦𝘴 𝘵𝘩𝘦 𝘋𝘢𝘮𝘢𝘨𝘦 𝘊𝘢𝘶𝘴𝘦𝘥 𝘣𝘺 𝘌𝘭𝘦𝘤𝘵𝘳𝘰𝘱𝘰𝘭𝘭𝘶𝘵𝘪𝘰𝘯 𝘢𝘯𝘥 𝘏𝘰𝘸 𝘠𝘰𝘶 𝘊𝘢𝘯 𝘗𝘳𝘦𝘷𝘦𝘯𝘵 𝘐𝘵.

CHD Staff Attorney Risa Evans, who helped write CHD’s petition, said she was pleased that the court is interested in the issue.

“While the FCC has been sitting on its hands and failing to protect the public from harmful levels of wireless radiation, it has been doing all it can to accelerate deployment of wireless infrastructure,” Evans said.

Thus, scientific uncertainty does not exempt manufacturers from their duty to inform. On the contrary, it requires making clear and understandable information available. In this way, every user can manage their own exposure to risks.

The right to information becomes a fundamental right
Furthermore, the Supreme Court recognizes that the right to be informed about health risks constitutes a fundamental right.

Consequently, it paves the way for financial compensation. This harm exists as soon as the consumer’s freedom of choice is hindered, even in the absence of proven bodily injury.

As highlighted by the newspaper La Gazzetta del Mezzogiorno:

“The violation of the consumer’s right to self-determination becomes an autonomous and compensable harm, regardless of whether health damage exists or not.”

Professor Lennart Hardell Calls for ‘Dismantling of 5G’
