⚖️ Cheshire West Has Been Overturned – What Happens Next?

The Supreme Court has changed the legal test used to decide whether someone is being deprived of their liberty. This is a major development for care homes, supported living services and healthcare providers.

Although the law is changing, our commitment to protecting people’s rights, dignity and wellbeing remains exactly the same.

We’ve created this simple infographic to help providers understand:
✅ What has changed
✅ What hasn’t changed
✅ What this means for inspections
✅ What actions providers should take now

If your service needs support understanding the implications of the ruling, Melia Medical is here to help.

One of the challenges in turnaround consultancy within social care is that success is not always reflected immediately in a CQC rating.

As a care consultant, I’m often brought into services when they are rated Inadequate or are facing significant operational concerns. My role is to stabilise the service, improve safety, strengthen governance, support the team, and help create sustainable improvements for residents and staff alike.

In many cases, by the time the real transformation has taken place, restrictions have been lifted, embargoes removed, safeguarding concerns resolved, and the service is operating safely and effectively again — but CQC may not yet have returned to reinspect. This means the published rating can still appear unchanged for some time after the work has been completed.

When choosing consultancy support, it’s important to look beyond the headline rating alone. Consider whether the service is now operating without restrictions, whether organisational safeguarding concerns have been resolved, and what feedback clients themselves give about the support they received.

Turnaround work often happens quietly behind the scenes, but the impact is seen every day in safer services, more confident teams, and improved outcomes for the people who matter most.

Strong care services are rarely built by chance. They are built through consistent governance, accountability, and the willingness to invite external scrutiny before problems escalate.

One of the most effective ways to support service stability and successful turnaround in care homes is through regular external consultancy. An experienced external consultant brings an objective perspective, identifying gaps in compliance, governance, culture, documentation, leadership oversight, and operational processes that internal teams can sometimes become too close to see.

Too often, providers view consultancy as an unnecessary expense.

“£500 per day sounds expensive.”

But compare that to:

* A safeguarding investigation
* Enforcement action
* An admissions embargo
* Agency overspend caused by instability
* Loss of occupancy
* Reputational damage
* Months of reduced revenue
* The long-term impact of a poor inspection rating

Suddenly, proactive support becomes one of the best investments a service can make.

Strong governance is not about reacting when things go wrong. It is about creating systems, oversight, and accountability that prevent deterioration in the first place.

Regular external review helps services:
✔ Identify risks early
✔ Improve oversight and compliance
✔ Strengthen leadership confidence
✔ Support staff accountability
✔ Embed sustainable processes
✔ Drive continuous improvement
✔ Maintain high standards of care

Sometimes the most valuable thing an organisation can have is an independent pair of eyes willing to ask the difficult questions.

The cost of prevention will almost always be lower than the cost of recovery.

One of the most common issues we identify in care and nursing environments isn’t a lack of policy or process — it’s complacency.

Over time, standards can slowly drift. Small shortcuts become accepted practice, accountability weakens, and a lax culture begins to take hold. The danger is that this rarely happens overnight, which makes it harder to recognise from within.

Culture directly influences:

* Quality of care
* Resident safety and dignity
* Team morale and accountability
* Regulatory outcomes
* Staff retention and performance

The reality is that culture can be one of the hardest things to repair once poor habits become embedded. Changing culture requires more than training sessions or updated policies — it demands strong leadership, consistency, visibility, and a willingness to challenge behaviours that have become “normal.”

The best-performing services are usually not the ones without problems — they are the ones that address issues early, maintain standards consistently, and create environments where accountability is part of everyday practice.

Strong cultures do not happen by accident. They are built deliberately, protected consistently, and reinforced daily.

Ready for our next round of recording 🎙️

Hopefully we’ve ironed out all the creases and can finally produce something releasable. It’s all part of the process — refining, improving, and showing up again.

Let’s see what we create this time.

There’s often a bit of confusion around what a care consultant actually does — and I think it’s worth clearing up.

A lot of people assume we’re there to “inspect” services or replicate what the regulator does. Especially when it comes to mock CQC inspections, there can be an expectation that it should feel exactly like the real thing.

But in reality, that’s not where we add the most value.

Yes, we absolutely identify gaps, risks, and areas that need improvement — but the real difference is what comes next.

A good care consultant doesn’t just point out what’s wrong and walk away. We work alongside providers to:
• Explain why something isn’t working
• Break down what “good” actually looks like in practice
• Provide clear, realistic actions to improve
• Support teams to embed those changes sustainably

A mock inspection shouldn’t just replicate pressure — it should build confidence, capability, and readiness.

Regulators highlight issues. Consultants help you fix them.

If you’ve worked with a care consultant before, I’d be really interested to hear — what made the biggest difference for you?
