Have you been told that your NHS surgery is set to take place at a private hospital?

You probably feel some relief after finally being told your long-awaited operation will be going ahead - and you’re likely looking forward to being treated in somewhat nicer facilities with better food!

However, while many patients receive good care in these settings, private care doesn’t automatically mean safer or better care.

Our firm is seeing a growing number of enquiries from individuals who say they experienced poor treatment, delays in recognising complications, inadequate aftercare, or confusion about who was responsible for their care after something went wrong.

Here are some things to be mindful about in regards to why NHS care is being outsourced privately, the potential risks, and what your rights are if something does go wrong.

You can read more about NHS care in private settings over on our latest blog where we share examples of some relevant cases our team have settled or are investigating.

After an outstanding legal career spanning more than three decades, we bid a fond farewell to our wonderful colleague Sarah Johnson as she retires from practice.

Qualifying as a solicitor in 1991, Sarah built an exceptional reputation in medical negligence law, spending 25 years at Heptonstalls in Goole where she became a Head of Department and Partner, before joining our firm in 2020 to establish and lead our second office in York.

Throughout her career, Sarah has been a steadfast advocate for clients facing some of life's most difficult circumstances. Her patient, kind, compassionate and understanding approach has earned the trust and admiration of countless clients, many of whom have described her as nothing short of phenomenal.

She has also spent almost 30 years in a voluntary role as a panel member of Action against Medical Accidents, as well as gaining accreditation from The Law Society's specialist clinical negligence panel.

Sarah's expertise, leadership and commitment have played a vital role in the growth and success of our firm, and her influence will be felt for many years to come.

On behalf of everyone at Medical Solicitors, we thank her for her dedication, professionalism and friendship, and we wish her a long, happy and well-deserved retirement.

📢 Office Announcement: We have welcomed a new temporary colleague to the firm.

Meet Chips, a Bengal kitten who has joined us a Head of Professional Distraction while he receives regular feeds to increase his weight.

While he hasn't yet mastered legal drafting - or recorded any billable hours - he has successfully negotiated frequent feeding breaks, unlimited fuss and several favourable settlements involving treats.

Chips' siblings are called Cheese and Beans, although we feel Chips may have secured the strongest position in the family naming dispute.

As we come to the end of Stroke Awareness Month, here are a couple of stroke-related negligence cases that our team have investigated and achieved compensation for.

🔹£825,000 for Stroke After Osteopathy
This was handled by Caroline Moore for a claimant in his 40s who had two major cerebellar strokes after visiting the osteopath. Following the initial visit, Caroline's client developed symptoms such as severe headaches and neck pain that didn't go off with painkillers. Despite telling the osteopath this, they continued to manipulate his neck and he ended up having two strokes in two days. He suffered permanent brain damage and had to give up his successful business.

🔹£400,000 for Paralysis After Failures on Stroke Ward
This case was handled by Matthew Brown for a claimant in her 70s who had a stroke that led to permanent paralysis down one side of her body. She was being monitored on a stroke ward after having a TIA or mini stroke. During the night, she felt increasing weakness in her hand but was reassured and told to go back to sleep. The next morning, she was paralysed. There were failures to escalate her care and give clot-busting drugs.

Our latest blog looks at some of the potential issues that may happen when NHS patients are treated in private hospitals with examples of negligence cases our team have investigated.

Bank holiday is upon us and we’re set to have some sun at last! ☀️
But while we're all no doubt craving some better weather after all the dismal rain we've had, it's important to practice safe sun exposure, as UV damage which is one of the main causes of skin cancer.
Covering up skin, wearing high factor SPF and staying in the shade between 11am and 3pm are ways to reduce your risk of being harmed by the sun.

As May is Skin Cancer Awareness Month here's a reminder of the two different types of skin cancer:
🔵Melanoma - a new mole or change to an existing mole. Irregular in shape, often more than one colour, may be itchy, bleed and change shape, size or colour.
Less common but more serious as it can grow down into the layers of the skin, increasing the risk of spreading to other parts of your body.
A biopsy should be done to check whether suspicious moles are cancerous.

🔵Non-melanoma - a firm, red lump or discoloured scaled patch on the outer layer of the skin. Feel tender to touch, may increase in size, bleed or turn into an ulcer.
Make up 95% of all skin cancers but less serious as they don’t usually doesn’t spread to other parts of the body.

𝐈𝐟 𝐢𝐧 𝐝𝐨𝐮𝐛𝐭, 𝐜𝐡𝐞𝐜𝐤 𝐢𝐭 𝐨𝐮𝐭!
Tell your doctor about any changes to a mole or patch of skin, or a new mole or mark.
If caught early, many skin cancers can be successfully removed with surgery. If not, a patient is at risk of their cancer becoming more advanced.

But sadly, some patients experience delays to diagnosis or treatment, resulting the cancer advancing or requiring more invasive surgery. We have recovered compensation for many people who have been harmed due to negligent skin cancer care.
