AI 重塑低空創意版權生態 ARTopia：以專利與制度破解保護難題

(香港文匯報) 人工智能全面介入文化創意與低空經濟領域，正徹底改寫傳統創作模式與版權規則。X Social Group 行政總裁、香港浸會大學兼任講師林漢源，以其主導的「ARTOPIA」無人機慈善表演為真實案例，揭示 AI 共創帶來的版權斷鏈、權屬碎片化、侵權取證難等核心困境。他認為，透過申請方法專利構建法律護城河、完善法規和認證機制，才可為香港低空經濟與創意產業築牢發展根基。
「AI 介入後，版權瞬間進入真空期。」林漢源直言，「ARTOPIA」項目經歷兒童原畫、AI 風格轉化、3D 建模與無人機編排三段式共創，兒童原畫版權清晰，但經生成式 AI 二次創作後，原創性認定與權屬歸屬變得極為模糊，形成「貢獻者叢林」亂象，令商業化寸步難行。

他指出，香港現行《版權條例》雖承認電腦產生作品可受保護，但「作出所需安排的人」定義模糊，導致AI共創場景下權屬極易碎片化。具體而言，下達提示詞的用戶、調整風格的後期創作者、提供原始畫作的兒童作者，乃至AI模型背後的開發者，均可能各自主張對最終作品的貢獻，形成「貢獻者叢林」亂象。一旦其中任何一方拒絕授權，整個IP便無法商用。至於AI訓練數據中所使用的第三方作品權利人，其權利並不直接延伸至AI生成的新作品，但若涉及未經授權的訓練行為，則可能引發獨立的版權侵權爭議，進一步增加法律不確定性。

面對法律灰色地帶，林漢源團隊選擇主動出擊，正向香港知識產權署申請方法專利，保護從兒童畫作轉化為無人機飛行圖案的整套流程，而非單一圖案成品。「版權保護表達，專利保護方法，兩者互補形成雙重防線。」他強調，方法專利保護人類設計的技術方案，即使部分內容由 AI 生成，只要人類深度介入轉化步驟與流程設計，就具備專利基礎，有效規避純 AI 內容不受版權保護的困境。

林漢源建議，政府應從三方面完善保障：
一是明確 AI 二次創作中，下達提示詞、篩選調整的人類創作者為版權擁有人，釐清「電腦產生作品」權屬；
二是建立區塊鏈產權存證官方認證與資助體系，降低 AI 創作版權登記與取證成本；
三是優化「公平處理」豁免，增設非商業實驗期，為慈善、教學類 AI 二次創作提供法律彈性空間。

「新質生產力不只是技術突破，更是對創意根源的尊重。」林漢源表示，香港發展低空經濟、盛事經濟，必須讓創意團隊脫離法律裸跑狀態。其方法專利申請不僅為自身項目護航，更期望為 AI 共創與低空創意領域樹立可複製的 IP 保護範例。
