That's a costly mistake.

I've seen it happen repeatedly: engineers solve a genuinely novel problem during development, nobody flags it, and the moment the product launches — that invention enters the public domain. Gone.

The truth is, IP strategy and product design are the same conversation.

Here's what most product teams miss:

Patents must be filed before public disclosure. If you're not thinking about it during design, you're already too late.
How you build something matters as much as what you build. Implementation decisions determine what's protectable.
Freedom-to-operate analysis is a design constraint — not a legal formality. Discovering a patent conflict after launch means expensive redesigns.

Design vs Engineering — A Difference Many People Overlook

In product development conversations, the words design and engineering are often used as if they mean the same thing.

They don’t.

Design is fundamentally about understanding problems before solving them.
It focuses on people, usability, experience, and intent. Designers ask questions like: What should this product achieve? How should it feel to the user? What problem are we truly solving?

Engineering begins where clarity emerges.
It translates ideas into systems, structures, and mechanisms that actually work. Engineers focus on reliability, materials, manufacturability, tolerances, and performance.

If design defines what the product should be, engineering determines how it will exist in the real world.

The most remarkable products rarely come from design alone or engineering alone. They emerge when creative thinking and technical discipline evolve together from the earliest stage of development.

In my experience, the biggest failures happen when design and engineering operate in silos rather than as partners.
