Do you have questions about elective IV therapy?
Here’s what you need to know-
For Registered Nurses (RNs):
There is nothing in the Nursing Practices Act (NPA) or Board Rules that prohibit a nurse from owning his/her business. However, Board staff recommends that nurses exercise caution and critical thinking when considering practicing in a setting that offers elective IV therapy, hydration, and vitamin therapy.
Beginning September 1, 2025, HB 3749 (“Jenifer’s Law”)(https://capitol.texas.gov/tlodocs/89R/billtext/html/HB03749F.htm) limits the ordering of elective IV hydration to physicians who may delegate this task to APRNs or PAs acting under adequate physician supervision.
The administration of elective IV therapy may be performed by a physician, APRN, PA, or RN acting under acting under adequate physician supervision.
LVNs, EMTs, paramedics, and unlicensed personnel may not be delegated these services.

For Licensed Vocational Nurses (LVNs):
Elective IV therapy is NOT within the LVN scope of practice, and as of September 1, 2025, LVNs may not perform elective IV therapy. This law does not impact LVNs assisting with medically indicated IV therapy in hospitals or traditional care settings when a valid order, documented competency, and proper supervision are in place.
