📌 Telehealth Update: What Mental Health Providers Need to Know (CMS – 2026)

Big news for mental health & therapy providers using telehealth:

• Telehealth flexibilities continue through January 30, 2026
• Mental & behavioral health services keep special protections
• Audio-only visits are still allowed (with conditions)
• In-person visit rules are coming—but not for everyone

👉 Here’s the breakdown ⬇️

🧠 Mental Health Telehealth: What Stays & What Changes

✔️ Mental & behavioral health services are exempt from most geographic limits
✔️ Patients can continue receiving services from home
✔️ Urban and rural patients are treated the same
✔️ Applies to therapy, counseling, and SUD services

⚠️ Starting after January 30, 2026:

• New Medicare patients will need one in-person visit within 6 months before starting telehealth
• Established telehealth patients will need at least one in-person visit every 12 months

📞 Audio-Only Telehealth (Yes, It’s Still Allowed!)

Mental health providers may continue using audio-only telehealth when:

• The patient is unable or unwilling to use video
• The provider is capable of video but audio-only is clinically appropriate
• Services are behavioral/mental health related
• Applies to new AND established patients

This remains a key access option for many therapy patients 💙

🏥 Hospital-Based & Therapy Services (Important Change!)

⏳ Through January 30, 2026:
• Hospitals may bill for outpatient therapy & behavioral health services delivered remotely to patients at home

🚫 After January 30, 2026:
• Hospitals can no longer bill for most therapy services provided remotely to patients at home (except certain behavioral health scenarios)

Private practices should review billing models now.

📍 RHCs & FQHCs – Special Telehealth Flexibilities

✔️ RHCs & FQHCs may continue telehealth services
✔️ Behavioral health services paid under AIR/PPS
✔️ Home can remain the originating site
✔️ Non-behavioral telehealth allowed through December 31, 2026 using HCPCS G2025

Telehealth rules are not one-size-fits-all.

Mental health providers should:
• Review in-person visit compliance now
• Confirm POS coding (02 vs. 10)
• Audit audio-only documentation
• Prepare patients for upcoming visit requirements
