⚖️ TAYCO FARMS IMPORTANT H**P LAW UPDATE
We want our customers, retailers, and fellow Texans to understand what is happening to the h**p industry at both the FEDERAL and TEXAS levels.
There is a lot of information circulating online, so here are the major changes and where you can read them for yourself.
🇺🇸 FEDERAL H**P LAW | MAJOR CHANGE COMING NOVEMBER 12, 2026
Congress changed the federal definition of h**p through Public Law 119-37.
The new definition is scheduled to take effect November 12, 2026.
Under the new federal language, final h**p-derived cannabinoid products containing more than 0.4 milligrams combined total per container of total THC, including THCA, and certain other cannabinoids with similar effects would be excluded from the federal definition of h**p.
The law also changes how certain synthesized or manufactured cannabinoids are treated.
This is a massive change from the framework the h**p industry has operated under since the 2018 Farm Bill and could affect a large portion of the legal h**p products currently available in America.
This isn't something we're asking you to take our word for.

⭐ TEXAS | DELTA-8
Texas has also made a major change concerning Delta-8 THC.
Following the Texas Supreme Court's decision in the Sky Marketing case, the Texas Department of State Health Services says Delta-8 THC is a controlled substance, except for naturally occurring trace amounts produced by the h**p plant.
The state's scheduling action became effective July 31, 2026.
According to DSHS, products labeled as containing Delta-8 THC or found to contain more than naturally occurring trace amounts may be detained and referred to law enforcement.
🌿 TEXAS | THCA & TOTAL THC TESTING
THCA is also being affected by changes at the state level.
Governor Greg Abbott's Executive Order GA-56 directed DSHS to revise Texas testing requirements so that testing measures total Delta-9 THC by accounting for both existing Delta-9 THC and the conversion of THCA into THC.
DSHS reported to the Texas Senate in July 2026 that it is currently enforcing rules adopted March 31, 2026 that include THCA in the total Delta-9 THC amount.
That's an important distinction.
This isn't simply a law saying “TABC banned THCA.”
DSHS regulates Texas's Consumable H**p Program, while TABC is assisting DSHS with inspections and enforcement and has additional rules applicable to TABC-licensed businesses.
🪪 TABC & TEXAS H**P ENFORCEMENT
Texas has also increased regulation and enforcement of consumable h**p products.
Current rules include:
21+ sales requirements
Government-issued ID verification
Additional labeling, testing and licensing requirements
TABC assistance with inspections and enforcement of DSHS h**p regulations
Restrictions on consumption of h**p products at certain TABC-licensed premises
Texas's h**p regulatory landscape has changed substantially, and additional changes remain possible.
