OBRA '90 says you document the offer EVERY time — whether counseling happened OR the patient refused. Skip that documentation step and it's a violation, even if you did nothing wrong on the counseling side.

The catch? Many states don’t fully adopt every federal Controlled Substances Act (CSA) rule. Relying only on federal law can lead to missed state-specific questions.

Watch for “daywalker” drugs like Soma, Gabapentin, and Fioricet, which may have different control schedules depending on the state. Also check who wrote the prescription—optometrists and other limited prescribers may have restrictions on prescribing or refills.

The UMPJE 2026 still emphasizes federal law, including the CSA, DEA regulations, HIPAA, FDA classifications, and DSCSA.
