A wave of major legal actions has been spearheaded by the Center for Environmental Health (CEH) against prominent activewear brands, including Alo Yoga, The North Face, Patagonia and many others, over allegations of toxic chemical exposure. The legal battle began intensifying when the consumer advocacy group issued formal notices of intent to sue and subsequent lawsuits under California’s Proposition 65. Independent testing conducted by the watchdog organization revealed that various polyester-and-spandex-blend garments contained ALARMINGLY HIGH levels of Bisphenol A (BPA). In some instances, the clothing exposed consumers to 40 times the safe limit of the chemical allowed under California law.
The core of these lawsuits rests on the brands’ failure to provide mandatory health warning labels to consumers regarding dermal exposure to endocrine-disrupting chemicals. BPA, which is frequently used in the manufacturing of synthetic plastics and polyester, can mimic estrogen and has been linked by health experts to serious health risks, including metabolic disruptions, reproductive harm, cardiovascular disease, and cancer. The litigation seeks to hold these multi-billion dollar apparel companies accountable by demanding hefty civil penalties and court-ordered injunctions to force the retailers to completely reformulate their products or permanently eliminate bisphenols from their supply chains.
🚩Traditional synthetic activewear is actually heavily saturated with MANY toxins besides BPA including plastic-based materials like polyester, nylon and spandex, which are frequently treated with chemical finishes like endocrine-disrupting PFAS “forever chemicals”, and heavy-metal dyes. When you sweat, your pores open up, making it easier for your skin to absorb these toxins.
