Friends, you may know that we LMT's in Louisville were blindsided last November with a punitive and restrictive "anti-human trafficking ordinance" that ONLY targets massage therapists, with no exemption for State licensees, unlike the ordinance it replaced.

This ordinance REQUIRES us to give our residential information to police.
It requires us to install surveillance cameras operaring 24/7 to register YOUR coming and going.
It requires us to check your photo ID.
It requires us to maintain a roster of identifying information, YOUR information, with what service we provide to you, and hand that to police, without a judicial warrant, whenever they ask.
It requires us to allow "any peace offer" in the door, keeping our doors unlocked, whenever and as often as they wish, without prior notification.

We are fighting this on multiple fronts, while also affirming our support of genuine anti-trafficking measures. Please help us keep ourselves safe, keep you safe and un-surveilled, and our offices sanctuaries of peace.
Please CALL YOUR Metro Council member and ask them to repeal ordinance LMCO 115.170 pending review.
Please sign this petition started by a Louisville LMT
Please spread the word.

I definitely missed being at for Ky Yoga Fest this year. The laughter, the drumming, the bodywork, the creative expression, one with the river, and leading a Skycladding session.
But i know I will see you all again.

In regards to the Louisville Metro anti-massage therapy ordinance....we need all the assistance from the public and related professionals (OTs, PTs, DCs, etc.) we can get.
Please show up to Metro Council meetings in our support.
Please contact your Metro Council member to state your opposition to the ordinance.
And please support here:

I am exploring a parallel path of seeking official legal opinions on whether
A. this ordinance is even legal.
B. avenues it can be attacked in the event legal proceedings against the city need to be initiated.
C. where we LMTs are vulnerable under the ordinance, and clarification on HIPAA and data handling from an actual HIPAA attorney.
D. areas in which the city is vulnerable to lawsuit, including class action, as reasons to induce them to repeal.
I have made arrangements with Atty. Mark Brengelman in Frankfort for
"a letter opinion covering the city ordinance, massage therapy licensure law, and the federal HIPAA law, and we would thereafter include a conference call or Zoom meeting of any (reasonable) duration with you and anyone supporting you to discuss the opinion letter".
I am collecting donations via Venmo to assist with covering the cost of this.
As someone told me recently, the $200 licensing fee is "just a couple of massages"......isn't it worth the cost of a couple massages to have clarity, to stand up for ourselves as professionals, and to find out where we stand? I certainly believe so. If you wish to be included, I am asking for donations of $200, but will accept any from any LMT to your ability to assist. Cost of the opinion letter and followup is $2000.

Additional info about Mark:
"As additional background, I am familiar with the HIPAA laws and have provided multiple webinars on HIPAA, I am familiar with the massage therapy licensure laws, and I actually represented the Louisville Metro Ethics Commission (2018-2023), so I have some familiarity with Louisville metro ordinances."

Why would I have an issue surveilling my patients, collecting my patients ID and data, and sharing that with police?? If I have "nothing to hide"......

Can you imagine if an ABC officer used MY patient's PHI to stalk someone??!

No to LMCO 115.170

Effective June 1st 2026, I am SUSPENDING my massage therapy practice in LOUISVILLE Ky, solely due to the anti-massage therapy ordinance passed by Metro Council. We are fighting this for an exemption for LMTs, but right now, as of June 1 am required to
Put surveillance cameras outside my office
To not lock my door when with a client
To hand over my ID to police when ever they ask
To take and photocopy YOUR ID
To keep a roster of patients with identifying information and service rendered, handing to the LMPD whenever requested
To allow in at all times I am open ANY code enforcement, health department, ABC, or ANY "peace" officer and allow them to conduct an inspection
Among MANY other things.
I view these as violations of my privacy, your privacy, Ky State LMT Code of Ethics, and possibly State and Federal law.
If I do not comply with any and all, I face a $1000 fine,
per "violation", per day.
I refuse to become and adjunct to police surveillance and state data gathering.
If you receive a massage in Louisville Ky, your provider WILL be doing these things.
If you value your privacy and right to healthcare without hoverment intrusion, please contact your Louisville Metro Council Member. Where are and on all this? GREAT question.
So far they have refused to be involved, or even to reply to enquiries. 🤷🏽‍♀️
