Questions Berkeley County Taxpayers May Want Answered

Berkeley County Schools has voted to pursue litigation regarding locality pay, special education funding, and other school funding issues. According to reporting, the Board unanimously authorized Bailey & Glasser to investigate and initiate litigation.

Before taxpayers potentially become involved in another legal battle, there are several questions worth asking:

Questions for Board President

1. What is the estimated cost of this litigation to Berkeley County taxpayers?

2. Has the Board established a maximum amount it is willing to spend on legal fees?

3. Will the litigation costs come from operating funds, reserve funds, or another source?

4. Has the Board publicly reviewed all alternatives before pursuing litigation?

5. What specific outcome is the Board seeking through the courts that it has been unable to achieve through the Legislature?

Questions for Superintendent Dr. Ryan Saxe

1. How much additional funding is Berkeley County Schools seeking through this litigation?

2. How much additional locality pay would be required to make Berkeley County competitive with nearby Maryland and Virginia school systems?

3. If the lawsuit is successful, how would those funds be distributed?

4. What data supports the claim that locality pay is the primary factor affecting recruitment and retention?

5. How many teaching positions are currently vacant?

6. How many employees have left Berkeley County Schools in the last three years for higher-paying positions in neighboring states?

7. What efforts have been made, short of litigation, to address these concerns?

8. How much additional funding does the district believe is needed for special education services?

Questions for the Community

1. Do you support using litigation to pursue additional school funding?

2. Should the state provide additional funding to counties that border higher-paying states?

3. If additional funding is awarded, how should accountability and transparency be measured?

These are questions, not accusations. Taxpayers have a right to understand the goals, costs, risks, and potential benefits of any litigation pursued on behalf of the school system.

To every mother who has lost a child, to every father yearning for reunion, to every sibling longing for the missing piece of their family—God is with you. He will uphold you. He will restore.

One day, your child will come back. Until then, stand firm, pray without ceasing, and let love be the force that never lets go.
