💙 Persistence matters.

After nearly 11 years, a federal black lung claim filed in December 2015 has finally reached a successful conclusion.

Although the miner passed away before seeing the final decision, his widow will now receive federal survivor's benefits, along with approximately $82,000 in past-due benefits that accumulated while the claim was pending.

Black lung claims can take years to work through the legal process, especially when they are appealed. At Lungs at Work, we remain committed to our clients and their families for as long as it takes, whether that means months or more than a decade. We continue advocating until there is a final decision.

🎉 Another step forward for two families affected by black lung!

We're pleased to share that the Department of Labor has issued Interim Awards of Benefits in two of our clients' federal black lung claims.

An interim award is an important milestone in the claims process and means the Department of Labor has made an initial determination that these miners are entitled to federal black lung benefits.

Miners debilitated by the disease receive a small cash benefit and health insurance to cover associated costs, but the monthly payments haven't kept up with inflation.

We received notice that one of our miners received an interim award in his case for federal black lung benefits. The coal company may still appeal this decision, if that happens we will continue to fight for him by developing evidence and representing him in court.

Congratulations to the two miners who will be receiving their benefits!

Today we received notification that the Coal Companies in two separate cases were withdrawing their requests for hearings and agreeing to pay benefits to the miners!
