Patient Drive and Mobile Clinic Compliance Information
To clarify questions regarding the legality of Patient Drives, CPKS Chief Executive Officer Jenn Jones requested written guidance from the Oklahoma Medical Ma*****na Authority (OMMA) Compliance Team. OMMA provided the following position for compliance purposes:
OAC 310:681-5-18 — Prohibited Acts
(d) No dispensary shall allow any physician to be located on-site, maintain an office, issue recommendations, or otherwise provide medical services to patients at the same physical address as the dispensary.

Dispensaries may maintain compliance by engaging a third-party provider (e.g., CPKS, LLP Uncensored Family Medicine, in association with Okie Budz Network) to support patient intake and application assistance, provided that no physician is physically present on the premises and no recommendation is issued on-site.
Two service models for off-site assistance are available to assist patients with obtaining a new or renewed medical ma*****na license while remaining compliant with OMMA requirements:
Patient Drive (Permitted on Dispensary Property) — An advocate will assist patients on-site with completing the forms required for OMMA submission and scheduling a telehealth/virtual physician appointment with an OMMA-registered provider from CPKS, LLP Uncensored Family Medicine. Okie Budz Network supports the process by entering the required information, uploading the appropriate OMMA application, and submitting the state fee on the patient's behalf after the physician visit is completed. The physician uploads the patient's recommendation to the patient's chart electronically, with the upload date recorded. Upon completion, the patient will receive the medical ma*****na license by mail.
Mobile Clinic (Not Permitted on Dispensary Property) — This model follows the same intake process described above; however, the physician visit is conducted on-site, and a medical ma*****na recommendation is issued on the premises. OMMA does not permit this activity on dispensary property, including parking areas or any location within the physical boundaries of the premises.
Pediatric Appointments: Initial pediatric appointments are conducted virtually and are scheduled for a later date. The parent or legal guardian and the minor patient must be present for the appointment. The process includes a single appointment and a follow-up call to complete both the required recommendations.
