Part-Time Remote Legal Assistant/Paralegal needed for sole practitioner in Florida. Some job responsibilities include:

• Coordinating with courts, opposing counsel, clients, and witnesses
• Scheduling hearings, depositions, mediations, arbitrations, and phone conferences
• Securing court reporters
• Drafting, filing, and saving notices for proceedings
• Drafting and following up on record requests and subpoenas
• Responding to high volume of emails promptly

Statute of Limitation: What You Have to Know!

A statute of limitations (SOL) is a law that sets the maximum time that parties have to initiate legal proceedings from the date of an alleged offense. In Florida, there’s an SOL for negligence/personal injury, malpractice, breach of contract, product liability, and many other causes of action. If you think you have ANY type of legal claim, ALWAYS consult with a lawyer who can advise you of the applicable SOL as soon as possible. If you don’t, you may risk losing your right to file a lawsuit.

How to Calculate Child Support in Florida

Child support is determined based primarily on the following: (1) the net monthly income of both parents, (2) the number of children in common, (3) and the amount of time the child(ren) spend with each parent every month. These figures are imputed into Florida’s Child Support Guidelines Worksheet (https://www.flcourts.gov/content/download/685815/file_pdf/902%28e%29.pdf ) to determine the presumptive child support payment. It’s ‘presumptive’ because the parties can ask the court to enter an order for more or less than this suggested amount. For example, you may ask for more because you believe the other parent will not exercise all their time-sharing. Or you may ask for less if one of your children has an independent source of income (e.g., supplemental security income). How to Form an LLC in TWO EASY STEPS:

(1) Go to the Sunbiz.org website (that’s what Florida calls its Division of Corporations) to fill out the registration paperwork: https://dos.fl.gov/sunbiz/start-business/

(2) Go to the IRS website to get your EIN (Employer Identification Number): https://www.irs.gov/businesses/small-businesses-self-employed/apply-for-an-employer-identification-number-ein-online

That’s it! Your LLC is now licensed to do business in Florida!

5 WAYS TO AVOID PROBATE IN FLORIDA

(1) Ask your bank about a Transfer on Death account. TOD accounts will transfer to the beneficiary when the account owner dies. No need to probate.
(2) Record a Lady Bird Deed. Also called an Enhanced Life Estate Date, this gives you a life interest in your Florida property and when you pass, it automatically transfers title to whomever you designate. No probate required.
(3) Have a small estate with assets totaling less than $2,000. Estates this small are usually eligible for Disposition Without Administration (i.e., disposition w/o probate).
(4) Place your estate in a trust. This is a more expensive option but is a way to bypass probate.
(5) Gift your assets during your lifetime. In 2023, the IRS allows you to gift up to $17,000 per year without incurring any gift tax consequences.

This is not an all-inclusive list. There may be other ways to avoid probate depending on your specific situation. Give me a call if you’d like to learn more!
