PRESS RELEASE -Court Dismisses Several Counts in Case Filed Against Board of Health

(Seneca County, June 15, 2026) - The Seneca County Common Pleas Court has granted the Seneca County Board of Health’s motion to dismiss three counts of a complaint filed by WIN Waste Innovations of Seneca County against the Board. The court found WIN Waste didn’t state a claim that the Board violated the Ohio Open Meetings Act as was alleged in counts two through four of the complaint. Another count of the complaint was not subject to the motion and will be decided at another time.
The court’s journal entry points out that the case is one of seven filed by or involving WIN Waste arising from the Board’s decisions involving the landfill’s operating license. The court noted that while WIN Waste alleged it filed suit to ensure government transparency, it waited two years from the first alleged violation to sue and initially sought to recover a civil penalty of $500 for each of the 88 separate alleged Open Meetings Act violations. The court concluded that WIN Waste did not state a claim for any violations as alleged in the dismissed counts.
“We’re gratified that our local court followed the law and granted the motion to dismiss,” Seneca County Board of Health President Clay Wolph said. “The landfill is forcing the Board to spend taxpayer funds to fight in court. Still, we have and will continue to keep the health and safety of our communities at the forefront when making decisions.”

Poison hemlock is a highly toxic plant that’s a member of the carrot family. It’s commonly mistaken for wild carrot, wild parsnip, or wild parsley. This can lead you to accidentally eat it.

Every part of the hemlock plant is poisonous, including the seeds, root, stem, leaves and fruit. It can be fatal if ingested.

Poison hemlock resembles Queen Anne’s lace. Settlers brought the plant to the United States from Europe as a garden plant. Today, it grows throughout every region of the U.S. It grows along fences, roadsides and ditches, and in marshes, meadows and other low-lying areas.

If you have eaten this poisonous plant, call 911 or go to your nearest emergency room. Hemlock poisoning can cause severe symptoms within 15 minutes of ingestion.

Check out these helpful tips on how to protect yourselves from ticks and how to remove them when you're out enjoying your Ohio State Parks, Ohio Division of Wildlife areas, Ohio Division of Natural Areas and Preserves state nature preserves and Ohio Department of Natural Resources Division of Forestry state forests!

Tick bite prevention:
➡️ Know when and were to expect ticks and use repellents according to labels.
➡️ Tuck your pants into your socks and boots and tuck your shirt into your pants.
➡️ Check yourself, family and pets regularly and remove ticks immediately.

How to remove a tick:
➡️ Don't panic.
➡️ Use tweezers to remove the entire tick, including the mouth.
➡️ Monitor your health the following days for any symptoms.
