The most expensive mistake I see families make is completely avoidable. But only while you're still alive.
I just handled a listing where my client's brother passed away with no trust, no will, nothing in order. She lived in another state. Everything went to probate, and here's the part people don't understand. Attorney fees in probate are calculated on the gross value of the estate, not what's actually left after the mortgage.
A million-dollar home with an $800,000 loan means $200,000 in real equity. The attorney fee still gets calculated off the full million.
That's $23,000 gone before the family sees anything. Probate is also public, and it can drag on for over a year.
I'm not an attorney, and this isn't legal advice. But if you own a home, please talk to an estate attorney and set up a trust. Do it for the people who will be grieving you while they sort through everything you left behind.
If you don't know where to start, send me a message, and I'll point you to the right people.
