Krystena Murray, a woman from Georgia, is suing Coastal Fertility Specialists after being mistakenly inseminated with another couple’s embryo during her IVF procedure. The fertility clinic informed the other couple, who then sued Murray for custody of the child. Despite her strong bond with the baby, Murray ultimately gave up custody during a family court hearing in May 2024, leaving her devastated and emotionally broken.

Murray, represented by Peiffer Wolf Partner Adam Wolf, filed a lawsuit against the fertility clinic. As reported by the Daily Beast, she described the experience as shocking and violating, expressing the deep emotional toll it has taken on her. The lawsuit claims that the fertility clinic’s mistake led to not only the loss of her baby but also significant emotional trauma.

Peiffer Wolf Partner Adam Wolf is representing Krystena Murray in a lawsuit against Coastal Fertility Specialists after a mix-up at the clinic led her to give birth to a child that was not biologically hers. Speaking with the New York Times, Murray explained that she had sought IVF services at Coastal Fertility to conceive a child using a s***m donor. However, after the child was born in December 2023, she discovered that the baby was not genetically related to her, which led to the revelation that an embryo mix-up had occurred at the clinic.

"Stories of I.V.F. mix-ups [...] are harrowing for all involved, often leading to gut-wrenching decisions about a child’s future, sometimes years after the child has been raised by people who are not the biological parents."

The woman, a Georgia resident, lost custody of the child she had carried. The in vitro fertilization clinic, Coastal Fertility Specialists, apologized for “an embryo transfer mix-up.”

A former patient of Coastal Fertility Specialists, which operates fertility clinics in South Carolina and Georgia, filed a lawsuit against the company for implanting the wrong embryo into her uterus, resulting in her carrying and giving birth to another couple’s biological child.

The lawsuit was filed in Georgia state court, in Savannah, by Adam Wolf of the law firm Peiffer Wolf Carr Kane Conway & Wise.

Adam Wolf: “Coastal Fertility Specialists made a very serious error, and the consequences are life-altering. This should never happen in a fertility clinic. Unfortunately, the United States does not have meaningful fertility industry oversight. Until IVF clinics are subject to real regulations, reporting requirements and mandatory certification programs for lab staff, these mishaps will continue to occur.”

CooperSurgical faces multiple lawsuits over the recall of its embryo culture solution, which is used for in vitro fertilization (IVF) procedures at clinics across the world and was later discovered to kill embryos.

The lawsuits were filed in the Superior Court of California by Peiffer Wolf Carr Kane Conway & Wise on behalf of two Los Angeles couples whose embryos were killed.

According to the lawsuits, CooperSurgical issued a recall of several lots of its embryo culture media, including at least LGGG Lots 231020-018741, 231020-018742, and 231020-018743. However, the company intentionally did not disseminate any notice of the recalled lots publicly.

A renowned fertility doctor and former Harvard Medical School professor, Dr. Merle Berger, was hit with a major lawsuit for secretly impregnating his patient, Sarah Depoian, with his own s***m. Sarah went to Dr. Berger for an intrauterine insemination (“IUI”). Dr. Berger told Sarah that the s***m would come from an anonymous s***m donor “who resembled her husband, who did not know her, and whom she did not know.” Sarah’s daughter, Carolyn Bester, discovered that Dr. Berger was her biological father after using a home DNA test kit this year.

Carolyn Bester, daughter of Sarah Depoian, said: “To say I experienced shock when I figured this out would be an extreme understatement. It feels like reality has shifted. I just want to say how proud I am of my mom for speaking out, and I’m honored to stand by her side.”

"Overturning Roe v. Wade will have vast, far-reaching ramifications for the fertility industry. The opinion includes numerous references to 'the unborn human being,' 'potential life,' and 'the life of the unborn.' Much of that language -- and the logic behind it -- applies to embryos," said Adam Wolf, a fertility attorney for Peiffer Wolf Carr Kane Conway & Wise, in a statement Friday.
