T's and C's apply. South Africa is a dynamic country with Legislation in place aimed at ensuring that the public of South Africa enjoys Social insurance cover in certain instances. For example, if a person was involved in a motor vehicle accident or injured whilst on duty, the Government is obliged to pay the medical expenses for those injuries relating to that incident, subject to certain terms a
nd conditions with reference to Merits and administrative documents that needs to be completed in accordance with Legislation. Should such incident occur and you have adhered to the terms and conditions, Government will be obliged to pay for the medical expenses. This is an administrative obligation that the Government has towards the public of South Africa. Throughout the years Government has failed to adhere to this obligation, although Section 33 of the Constitution of South Africa grants the public the right to administrative action from the Government that is lawful, reasonable and procedurally fair. National Social Insurance helps several service providers through their partners, Podbielski Mhlambi Inc. Attorneys and WCA Solutions, to recover the medical costs from Government. In the event of Government failing to adhere to the aforesaid obligation, the public does have the right to approach the Court to enforce same. Most of the time the Government’s failure in administration could result in the public’s rights being deprived to receive the best medical assistance, which they are entitled to.
