Representative Anna Paulina Luna, a Florida Republican, has spent much of the past two years pushing legislation that would allow the dath penalty for convicted child sx offenders, arguing that predators cannot be rehabilitated.
In April 2024, Luna introduced the No Repeat Child Sx Offenders Act, which would increase the federal minimum punishment for child rpe and sxual abse to either life in prison or dath. She followed that effort in January 2025 with a related package of bills targeting child prnography, trafficking, and sxual abse. At the time, Luna said predators “deserve the d*ath penalty or to rot in jail where they belong—no mercy, no escape.”
Luna also said she discussed the proposals with then-President-elect Donald Trump at Mar-a-Lago in January 2025 and told Fox News Digital that she believed he was supportive of the effort.
She has continued pushing the issue in response to cases in Florida. After a Pinellas County foster parent was arrested on child exploitation charges in June 2026, Luna publicly urged Florida Attorney General James Uthmeier to pursue the d*ath penalty. Uthmeier said his office was reviewing the case.
But Luna’s proposals face a major constitutional hurdle. In Kennedy v. Louisiana, the U.S. Supreme Court ruled in 2008 that the dath penalty cannot be imposed for crimes against an individual, including child rpe, when the victim is not klled. Legal analysts say that precedent would likely form the basis of a challenge if Luna’s legislation became law. No state, including Florida, currently has a child-rpe capital punishment law that has survived that Supreme Court precedent.
