The Americans with Disabilities Act of 1990 (ADA) is a landmark disability law. It requires businesses, employers, and government bodies to be accessible to people with disabilities. The act passed due to activism by people with disabilities, such as the Capitol Crawl.

When a place or service isn’t accessible, the ADA gives people with disabilities the power to sue. But many disabled people can’t afford or don’t have the time to file lawsuits. Many folks don't even know where to begin when navigating these systems.

That’s why Protection and Advocacy agencies (P&As) are so important. P&As enforce the ADA for people who can’t afford lawsuits.

But that’s only the beginning.

Many places focus only on compliance with the exact guidelines ADA. This results in people with disabilities only receiving the bare minimum accommodations.

So P&As also work to expand legislation for disability rights. Because people with disabilities deserve access to all the supports they need to live equitable, fulfilling lives in their community.

Big news for Kansas voters: Today’s ruling restores the three-day grace period for mail ballots! This protection is especially important for thousands of Kansans with disabilities who rely on voting by mail. DRC is proud to stand up for our voting rights alongside Kansas Appleseed and Loud Light. We will continue fighting to stop Senate Bill 4 for good.

Breaking News: Today, the District Court of Douglas County granted a temporary injunction blocking Senate Bill 4, the 2025 law that eliminated Kansas's three-day grace period for mail ballots postmarked by Election Day. The statewide injunction immediately restores the grace period that Kansas has used since 2017, ensuring that mail ballots postmarked on or before Election Day will be counted if received within three days.

From the Plaintiffs: Today's ruling affirms a crucial principle: Kansas voters who follow every rule must never lose their ability to participate in elections due to postal delays beyond their control. We are grateful that the court recognized the overwhelming, undisputed evidence that Senate Bill 4 would arbitrarily disenfranchise thousands of our neighbors, and acted to protect Kansans' fundamental right to vote while this litigation continues.
We will continue fighting to block Senate Bill 4 permanently.

So glad to have DRC’s very own Dallas Hathaway in such great company at the 36th anniversary of the ADA event! Great job, Dallas!

Today we attended a Proclamation Ceremony celebrating the 36th anniversary of the ADA. Members from the community and commission staff joined together to commemorate the amazing work of advocacy transcending through many generations. 🥳

The ADA ensures that people with disabilities have the same rights and opportunities as everyone else. It is divided into five main areas, known as titles which are - Title I (Employment), Title II (State and Local Government), Title II (State and Local Government), Title IV (Telecommunications), and Title V (Miscellaneous). 🦽

You may have heard about the recent DOJ memo that argues that seniors and people with disabilities DO NOT have the right to live in the most integrated setting in the community (typically, this means living in your own home). The right to avoid institutionalization and be provided access to supports to thrive at home was previously enshrined in Section 504 of the Rehab Act and the US Supreme Court’s Olmstead decision.

Much like the horrible Texas v Kennedy litigation, if this memo were to be implemented, it would force seniors and people with disabilities into institutions and strip them of their right to community based services, the same services that help them stay in their own home. This would be horrible for seniors, people with disabilities, and taxpayers alike (as institutional beds are dramatically more expensive than in-home supports).

Disability rights should not be up for debate!

We appreciate Attorney General Kobach's decision to withdraw Kansas from the lawsuit threatening Section 504, the cornerstone federal law that protects people with disabilities and seniors from discrimination. But Kansas dropping out of the case doesn't alleviate the danger it poses.

The lawsuit started with 17 states. Only six remain.

Attorney General Kris Kobach: Thank you for doing the right thing for Kansans with disabilities. We urge you to encourage your colleagues in Texas, Alaska, Florida, Louisiana, Missouri, and Montana to follow Kansas' lead and withdraw as well.
