Did you know that h**p is literally the same plant? 🌿

H**p and its more regulated counterpart are both classified as Cannabis sativa. The difference comes down to one thing: the amount of delta-9 THC present. Federal law defines h**p as the plant containing 0.3% delta-9 THC or less by dry weight. That one number is the legal line between what sits on our shelves and what does not.

Here in Texas, that distinction has never mattered more.

As of July 31, 2026, the Texas Department of State Health Services reinstated 2021 rules that reclassify most h**p-derived compounds (delta-8, delta-10, THCP, THCA flower) as Schedule I controlled substances.

The one exception - products containing 0.3% or less naturally occurring delta-9 THC by dry weight, which remain fully legal under both state and federal law.

So what does that mean for you?

Delta-9 products (edibles, tinctures, drinks) are still available and legal in Texas. Many of the other variants you may have seen on shelves over the past few years are no longer permitted under state law, and a federal court just denied an emergency request to pause that ban.

We only use non-synthetic ingredients, so we’re in the clear!

But (there’s a big ol’ but) we are completely against the incarceration and punishment of civil adults for making choices for themselves. The government should be there to protect the people, not just punish them. We are all sick and tired of being pushed to alcohol and prescriptions as the only options. Much like the looming federal ban, the people did not vote for this. This is another clear example of alcohol and to***co companies getting exactly what they want. We’re not fans of synthetics (not even a little), but laws should have logic and businesses should have clear guidelines. Without those two, the expectation that prohibition will work “this time” is quite honestly insane.

Please use this as a reminder to reach out to your local Senator and Congressman to voice your opinion. Businesses will close, farms will shut down, people will go to prison, and alcohol and to***co sales will go up. The best time to call was yesterday, the second best time is NOW! Thank you! 🙏

We hope all of the businesses and families affected by these draconian laws find solace in that the people are standing by them. 💚

Texas H emp just became a whole Netflix series that everybody is watching.

Delta 8, Delta 10, THCA... banned.

BUT here's the plot twist nobody's talking about. Delta 9 is still completely legal because it's naturally found in the h**p plant and protected under the federal Farm Bill.
